PROTEST PERIOD SUMMARY:

The proposed Brian Head Town Special Tax Assessment 2024-01 (Ranger Court) solicted written protests from parcel owners within the SAA area for a period of 60 days, ranging from August 27, 2024 through October 26, 2024.  A Public meeting will be held on November 12, 2024 at 1:00 p.m MST at the Town Hall Council Chambers located at 56 N. Hwy. 143, Brian Head, to review the following protests results:  18 lots total in the SAA area, with one (1) protest received, totalling 5.6% of the area.

Pursuant to Utah Code Ann. 10-2-406 Brian Head Town hereby gives notice as follows:

On February 14, 2024 a petition proposing the annexation of real property located at Section 36 Township 35 South Range 9 West, Salt Lake Base and encompassing approximately 1,799.02 acres was filed by Walter J. Plumb, G & P Ranch, LLC & Plumb Investments L.C. a Utah Limited Liability Company.

The area proposed for annexation in the petition is known as the Aspen Meadows Annexation and is described as follows and shown on the attached map:

  1. On February 27, 2024, the Brian Head Town Council accepted the Petition to be further considered and authorized the Petition to be certified by Town Staff.
  1. On March 27, 2024, the Town Staff certified that the Petition meets the requirements of Utah State Law, and notice was provided to the Brian Head Town Council, the contact sponsor, and the Iron County Commission.
  1. The complete Annexation Petition is available for inspection and copying at the Brian Head Town Clerk’s Office located at 56 North Highway 143, Brian Head, Utah, Monday through Friday, during the hours of 8:00 a.m. and 4:30 p.m.
  1. Brian Head Town may grant the Petition and annex the above-described area unless a written lawful protest to the Annexation Petition is filed with the Iron County Clerk, PO Box 429, Parowan, 84761 c/o Jon Whittaker, or delivered to the Iron County Clerk’s office located at 68 South 100 East, Parowan, Utah 84761. A copy of the protest must also be delivered to the Brian Head Town Clerk at the address noted above on the same date that the protest is filed with the Iron County Clerk.  Any protest must be filed as herein stated by no later than April 26, 2024 by 4:30 p.m.
  1. The area proposed for annexation to Brian Head Town will also be automatically annexed to have Brian Head provide fire protection, and emergency services or law enforcement services as applicable.
  1. The area proposed for annexation to Brian Head Town will automatically be withdrawn from Iron County providing fire protection and emergency services or law enforcement services, as applicable in which districts the town is not a part in accordance with State Code §10-2-406(2)(g) and (h).
  1. If no lawful protests are received, the Brian Head Planning Commission will hold a public hearing on Tuesday, May 21, 2024 at 1:00 p.m. in the Brian Head Town Council Chambers located at 56 North Highway 143, Brian Head, Utah, to consider the request to annex this property.
  1. If no lawful protests are received, the Brian Head Town Council will hold a public hearing on Tuesday, May 28, 2024 at 1:00 p.m. in the Brian Head Town Council Chambers located at 56 North Highway 143, Brian Head, Utah to consider the request to annex his property.
