The Town Council accepted the petition for the Brian Head Unit 3 SAA, which was followed by the adoption of a resolution for the Notice of Intent to create the Elk Drive SAA.  On August 26, 2026, the Council then adopted a Resolution for the Notice of Creation.

A Public hearing was held on September 23 2025, during the regular meeting of the Town Council in which property owners within the Brian Head Unit 3 SAA could voice their comments/protests during this time.

Elk Drive SAA

The Elk Drive Special Assessment Area (SAA) Petition was approved by the Town Council.  The Council then adopted a Resolution of Notice of intent to create the Elk Drive SAA and after a public hearing was held, the Council adopted a Resolution of Notice of Creation for the Elk Drive SAA.

NOTICE OF ASSESSMENT & BOARD OF EQUALIZATION

Notice is hereby given that the assessment list for the Brian Head Unit 3 Assessment Area has now been completed and is available for examination in the offices of the Town of Brian Head located at 56 N. Hwy. 143, Brian Head, UT.  The Town Council has appointed a Board of Equalization to hear and consider arguments from any person who claims to be aggrieved by the proposed assessment to be levied within the assessment area, including arguments relating to (a) the amount of benefits accruing to the property proposed to be assessed or (b) the amount of the proposed assessment.  The Board of Equalization will meet on the following dates to hear and consider any objections to and make any corrections of any proposed assessments that the Board of Equalization may deem necessary to meet the requirements of the Assessment Area Act, Title 11, Chapter 42, Utah Code Annotated 1953, as amended.

NOTICE OF BONDS TO BE ISSUED

NOTICE IS HEREBY GIVEN that pursuant to the provisions of the Utah Local Government Bonding Act, Title 11, Chapter 14, Utah Code Annotated 1953, as amended and a special bond election on November 21, 2023 (the “Bond Election”), the Town Council (the “Council”) of the Town of Brian Head, Iron County, Utah (the “Issuer”), adopted a resolution (the “Resolution”) on January 28, 2025, in which it authorized the issuance of the Issuer's General Obligation Bonds, Series 2025 (the “Bonds”) in the aggregate principal amount of not to exceed $2,500,000, to bear interest at a rate or rates of not to exceed 8.5% per annum, to mature in not more than 17 years from their date or dates, and to be sold at a price not less than 98% of the total principal amount thereof, plus accrued interest to the date of delivery.  As general obligation bonds, the Bonds will be secured by ad valorem property taxes as authorized in the Bond Election.  The Issuer has no more than $1,174,000 in outstanding general obligation bonds secured by ad valorem property taxes.  If the Bonds are issued at the maximum amount, interest rate and maturity, the amount to be repaid will be approximately $4,734,289.

The Bonds, pursuant to the Resolution, are to be issued for the purpose of (i) public safety and beautification and related improvements, and (ii) paying issuance expenses to be incurred in connection with the issuance and sale of the Bonds.

The Bonds are to be issued and sold by the Issuer pursuant to the Resolution, including as part of said Resolution the draft of a Final Bond Resolution which was before the Council and attached to the Resolution in substantially final form (collectively, the “Bond Resolution”), and said Final Bond Resolution is to be adopted by the Council in such form and with such changes thereto as shall be approved by the Council upon the adoption thereof; provided that the principal amount, interest rate or rates, maturity and discount of the Bonds will not exceed the maximums set forth above.

A copy of the Bond Resolution is on file in the office of the Town Clerk of the Town of Brian Head, Iron County, Utah located at 56 N. Highway 143, Brian Head, Utah, where it may be examined during regular business hours of the Town Clerk from 9:00 a.m. to 5:00 p.m. Monday through Friday for a period of at least thirty (30) days from and after the date of publication of this notice.

NOTICE IS FURTHER GIVEN that a period of thirty (30) days from and after the date of the publication of this notice is provided by law during which any person in interest shall have the right to contest the legality of the Bond Resolution or the Bonds, or any provision made for the security and payment of the Bonds, by filing a verified written complaint in the district court of the county in which he resides and that after such time, no one shall have any cause of action to contest the regularity, formality or legality thereof for any cause whatsoever.

Snowshoe/Toboggan SAA

The Snowshoe/Toboggan Special Assessment Area is scheduled to begin construction to install water and sewer lines in the spring/summer of 2025.

275 East Special Assessment Area

The 275 East SAA did not meet the State's requirements for creating a SAA due to the Value ratio.  The Town Council abandoned the 275 East SAA.
Ranger Court SAA

It was determined that the Ranger Court SAA did not meet the State's requirement for creating a Special Assessment Area due to the value ratio of property.  the Town Council abandoned the Ranger Court SAA.
