NOTICE TO ALL BRIAN HEAD HOMEOWNERS

WHO ARE RENTING THEIR CABIN/CONDO OR ARE

CONSIDERING THE RENTAL OF THEIR CABIN/CONDO

If you are currently renting or considering the rental of your cabin/condo on a short term rental basis (less than thirty (30) consecutive days), the following information pertains to you.

In order to rent your property as a short term rental  you must complete an application and obtain a business license from the Town of Brian Head.  You can download a business license application and find all other forms referenced on this page under the 'business license' tab. All business licenses are subject to processing times upwards of thirty (30) business days. In order to keep these processing times shorter, please read and understand all policies, expectations, and requirements.

FIRE INSPECTION
A fire inspection of the short term rental is required prior to renting out your home.  The requirement list will specify expectations pertaining to a condo or cabin. A fire inspection must be completed every other year after the initial inspection. No license will be issued until the fire inspection is completed.  The Business License Officer will contact you to schedule a fire inspection after a full application is submitted.

FEES COLLECTED

The fees to be paid will be itemized on your application. These include an application fee, fire inspection fee, and disproportionate service fee. This will be paid in full prior to any scheduling of inspections or obtaining a business license.

As a business, short term rentals are required to submit their Enhanced Service Business License Fee on a quarterly basis. This is a 1.5% fee based upon your gross earnings for the quarter. If you are working with a property management company, they will submit this report on your behalf. However, it is ultimately your responsibility as owner to verify this is paid.

Taxes Collected

As part of conducting nightly rentals, sales tax and transient room taxes  are to be collected.  Those using Airbnb, Vrbo, Travelocity, and other advertising platforms the state does collect and report these taxes on your behalf.

A sales tax ID# is required in order to hold a business license with Brian Head Town if you are not using an advertising platform. This includes all property management companies or self advertising websites.

CABIN Water Policy
Those who are or plan to rent their cabin as a short term rental, you are required by the Utah Public Health Department to be connected to water. You can find more information here under '6.0 Water Hauling' and '6.1 Water hauling is prohibited for commercial use, including use for short term rental properties'.

CONDUCTING BUSINESS WITHOUT A LICENSE
Those renting out their cabin/condo without a valid business license is in violation of Town Code 3-2A-1, (conducting business without a license) and is punishable as a Class B misdemeanor with a fine of up to $1,000 and a tripled application fee ($450).  All business license applications are submitted to the Deputy Clerk and the town staff will guide you through the necessary steps in order to become a valid business in Brian Head.
