RECENTLY ADOPTED ORDINANCES



As per state law, all ordinances are adopted by the Town Council in an open meeting.  As part of an open discussion, all ordinances are presented to the Council in their draft form to receive input from the Council and public before they are adopted officially in ordinance format.  Some ordinances require a public hearing be held prior to the adoption of the ordinance.  

Ordinances which pertain to the regulation of the public are identified in the Brian Head Town Code as law for the local municipality.   Not all ordinances are in the Town Code, such as personnel polices, meeting schedules, etc.  For a copy of any of the ordinances, contact the Town Clerk/Recorder and request a copy.  All ordinances are classified as public records.  

Listed below are the past five ordinances that have been recently adopted by the Brian Head Town Council:
 

  • Ordinance No. 12-001 - An ordinance adopting the 2012-2013 Brian Head Town Budget for the fiscal year ending June 30, 2013.  This ordinance also identifies an addendum adopting the Certified Tax Rate for the Town of Brian Head in the amount of 0.005640.  For further information on the 2012-2013 town budget, please contact the Brian Head Treasurer during normal busimess hours.  This Ordinance was adopted June 12, 2012 and the addendum for the Certified Tax Rate was adopted June 29, 2012. 

  • Ordinance No. 12-002 -  An Ordinance amending the Water Capital Facilities Plan for the town for water system improvements.  The Water Capital Facilities Plan is a plan which identifies the town's water system improvement projects and a timeline identified for implementation along with approximate costs for completing the projects.  If you would like to know more about the Capital Facilities Plan, please contact the Public Works Department during normal business hours.  This ordinance was adopted June 12, 2012. 

  • Ordinance No. 12-003.  An Ordinance amending the 2011-2012 Town Budget ending June 30, 3012.  This ordinance amends the 2011-2012 budget for the town.  Details of the budget are avaiable at the town hall.  This ordinance was adopted June 29, 2012.
  • Ordinance No. 12-004.  An ordinance granting the local Fire Official the authority to prohibit the use of any ignition source, including fireworks, lighters, matches and smoking materials within Brian Head Town along with a penalty for violations.  This ordinance grants the Brian HEad Public Safety Director, the authority to issue a fire restriction based on the danager of wildland fires.  The restrictions were put into effect July 01, 2012 and will continue to be in effect until October 01, 2012 or otherwise determined by the Brian Head Public Safety Director.  Details of the fire restrictions are posted on this website, or you can contact the Brian Head Public Safety Department or Town Clerk for further details.  This ordinance was adopted June 29, 2012. 

  •  Ordinance No. 12-005 - An ordinance establishing guidelines for the disposal of real property owned by the Town of Brian Head and an effective date.  This ordinance defines "significant parcel of property" which is now required by State law.  This will regulate the notification process for the sale of town owned property that is defined as signficiant parcel of property.  The Town Council has identified any real property larger than five (5) acres is a significant parcel of property and therefore, if the town were dispose of the property, a public hearing would be required.  Details of the ordinance are available in the office of the Town Clerk during normal business hours.  This ordinance was adopted June 29, 2012.
