Falcon Court Special Assessment Area


What is the Falcon Court SAA?
The Falcon Court Special Assessment Area consists of twenty-three (23) lots/properties and are located on Falcon Court, Fox Run, and a portion of Forest Drive  The property owners are requesting a waterline project that would serve the twenty-three s by submitting a SAA petition in which at least 50% of the property owners within the proposed SAA to the Town Council on July 27, 2021.  The Town Council accepted the petition and schedule a special meeting to consider a Notice of Intent resolution to create the Scenic Court SAA. 

Notice of Intent: 
As part of the Special Assessment Area requirements, a Notice of Intent was adopted by the Town Council on December 7, 2021 in a Special Council meeting.  The Notice of Intent to create the Scenic Drive SAA, officially gives notice to the public and property owners of a public hearing that was scheduled to be held on January 11, 2022 at 1:00 pm. It also states that a 60-day protest period will begin that will allow property owners within the Falcon Court SAA to submit written protests to be submitted until March 19, 2022.  

Written Protests:  
On March 22 2022, the Town Council held their regular meeting and reviewed written protests for the Falcon Court SAA.  No written protests were received for the Falcon Court SAA. 

According to state law, in order to a SAA to fail, there must be at least 40% of the properties that submit a written protest within the allotted timeframe.  The Town Council would then be required to adopt a resolution that would dissolve SAA officially.  


Creation of the SAA Resolution:
Since the town received no written protests, the Council can adopt the Notice of Creation of the Falcon Court SAA, which authorizes the town to bid out the waterline project, award the contract and start the final phases of the project.  The Town Council adopted the resolution to create the Falcon Court Special Assessment Area on March 22, 2022 during their regularly scheduled meeting.  

Going to Bid / Awarding the Contract for the Waterline project
The Town went to bid for the Falcon Court waterline project which closed on March 30, 2022.  The Council awarded the contract for the 2022 water / sewer line projects during their April 12, 2022 Town Council meeting in which Perco Rock was awarded the contract.

Board of Equalization:  As part of one of the remaining final steps, the Board of Equalization is appointed.  In which a three-member board consisting of the Town Council is appoint to act as the Board of Equalization and Review on the assessment proposed to be levied on the properties within the SAA pursuant to law.  What this means, is that the Board of Equalization met at the Brian Head Town Hall, 56 N. Hwy. 143, Brian Head, UT on May 18, 19 & 20, 2022 between 1:00 pm and 2:00 pm.  During this time, no property owner within the Falcon Court SAA petitioned the Board of Equalization regarding their lot(s).    

The total amount to be assessed to the property owners within the Falcon Court SAA is $478,889 in which each property owner will be assessed $20,821 per lot for water system improvements and the property owner will have the option to prepay the assessment or pay in annual installations.  

Final Assessment Ordinance:  Adopted May 20, 2022
The Final Assessment Ordinance was adopted during a special Council meeting on May 20, 2022 at 2:15 pm after the Board of Equalization and Review Hearings were adjourned.  The Final Assessment Ordinance identifies the final assessment along with the annual assessment for each property.  It also allows for the property owner to make a prepayment of their assessment, if they choose, within 25 days, after the 25 day period has passed, those who had not pre-paid their assessment up front will automatically have an annual assessment for a period of ten-years.  The document will be recorded with the Iron County Recorder's office and the annual assessment will be sent to the property owner along with their property tax notice.
